These Terms of Service ("Terms") govern your use of the Foraged and Found website and your purchase of goods from Foraged and Found Pty Ltd (ABN 95 685 823 170) ("we", "us", "our"). By accessing our website or placing an order, you agree to be bound by these Terms.

2. Products

All items sold by Foraged and Found are antique, vintage, or pre-loved goods. Due to the nature of our products:

  • Each item is unique and one-of-a-kind. Once sold, it cannot be replaced with an identical item.
  • Product descriptions and photographs are as accurate as possible, but minor variations in colour may occur due to screen settings.
  • We describe the condition of each item honestly. Signs of age, wear, and patina are characteristic of antique and vintage pieces and are not considered defects.

3. Pricing and Payment

  • All prices are listed in Australian Dollars (AUD) and include GST where applicable.
  • Payment is processed securely at checkout through Shopify Payments.
  • We reserve the right to update pricing at any time. The price at the time of your order is the price you pay.

4. Orders and Availability

  • Placing an order constitutes an offer to purchase. We reserve the right to accept or decline any order.
  • As our items are one-of-a-kind, availability is on a first-come, first-served basis. In the rare event that an item is no longer available after your order is placed, we will notify you promptly and issue a full refund.

5. Shipping and Delivery

  • Shipping costs and estimated delivery times are provided at checkout.
  • For larger or fragile items, we may arrange specialist delivery. Delivery quotes for oversized items are available on request.
  • Risk of loss or damage passes to you upon delivery.
  • We are not responsible for delays caused by shipping carriers or circumstances beyond our control.

Great care is taken to ensure your package arrives safely. However, Foraged and Found Pty Ltd is not liable for any damage that occurs during transit. Once an item has been handed to the shipping carrier, we are not responsible for damages, loss, or delays in delivery.

6. Returns and Refunds

Under the Australian Consumer Law, you are entitled to a refund or replacement if goods are:

  • Significantly different from the description or photographs on our website
  • Faulty or damaged on arrival (not including pre-existing wear described in the listing)
  • Not of acceptable quality

To request a return:

  • Contact us within 7 days of receiving your order
  • Provide photographs of the item and describe the issue
  • We will arrange a resolution, which may include a refund, exchange, or repair

Please note:

  • Change-of-mind returns are not offered on antique and vintage items due to their unique nature, unless required by law.
  • Items must be returned in the same condition as received.
  • Return shipping costs may apply unless the item was faulty or incorrectly described.

All content on this website — including text, photographs, logos, and design — is the property of Foraged and Found Pty Ltd and is protected by Australian copyright law. You may not reproduce, distribute, or use any content without our written permission.

8. Limitation of Liability

To the maximum extent permitted by law, Foraged and Found Pty Ltd is not liable for any indirect, incidental, or consequential damages arising from your use of our website or purchase of our products. Nothing in these Terms excludes or limits rights under the Australian Consumer Law that cannot be excluded or limited.

These Terms are governed by the laws of the State of Victoria, Australia. Any disputes will be subject to the jurisdiction of the courts of that State.
